Student Sues Wisconsin School After Getting a Zero for Religious Drawing

MADISON, Wis. —  A Tomah High School student has filed a federal lawsuit alleging his art teacher censored his drawing because it featured a cross and a biblical reference.

The lawsuit alleges other students were allowed to draw “demonic” images and asks a judge to declare a class policy prohibiting religion in art unconstitutional.

“We hear so much today about tolerance,” said David Cortman, an attorney with the Alliance Defense Fund, a Christian legal advocacy group representing the student. “But where is the tolerance for religious beliefs? The whole purpose of art is to reflect your own personal experience. To tell a student his religious beliefs can legally be censored sends the wrong message.”

Tomah School District Business Manager Greg Gaarder said the district hadn’t seen the lawsuit and declined to comment.

According to the lawsuit, the student’s art teacher asked his class in February to draw landscapes. The student, a senior identified in the lawsuit by the initials A.P., added a cross and the words “John 3:16 A sign of love” in his drawing.

His teacher, Julie Millin, asked him to remove the reference to the Bible, saying students were making remarks about it. He refused, and she gave him a zero on the project.

Millin showed the student a policy for the class that prohibited any violence, blood, sexual connotations or religious beliefs in artwork. The lawsuit claims Millin told the boy he had signed away his constitutional rights when he signed the policy at the beginning of the semester.

The boy tore the policy up in front of Millin, who kicked him out of class. Later that day, assistant principal Cale Jackson told the boy his religious expression infringed on other students’ rights.

Jackson told the boy, his stepfather and his pastor at a meeting a week later that religious expression could be legally censored in class assignments. Millin stated at the meeting the cross in the drawing also infringed on other students’ rights.

The boy received two detentions for tearing up the policy. Jackson referred questions about the lawsuit to Gaarder.

Sometime after that meeting, the boy’s metals teacher rejected his idea to build a chain-mail cross, telling him it was religious and could offend someone, the lawsuit claims. The boy decided in March to shelve plans to make a pin with the words “pray” and “praise” on it because he was afraid he’d get a zero for a grade.

The lawsuit also alleges school officials allow other religious items and artwork to be displayed on campus.

A Buddha and Hindu figurines are on display in a social studies classroom, the lawsuit claims, adding the teacher passionately teaches Hindu principles to students.

In addition, a replica of Michaelangelo’s “The Creation of Man” is displayed at the school’s entrance, a picture of a six-limbed Hindu deity is in the school’s hallway and a drawing of a robed sorcerer hangs on a hallway bulletin board.

Drawings of Medusa, the Grim Reaper with a scythe and a being with a horned head and protruding tongue hang in the art room and demonic masks are displayed in the metals room, the lawsuit alleges.

A.P. suffered unequal treatment because of his religion even though student expression is protected by the First Amendment, according to the lawsuit, which was filed Friday.

“Students do not shed their constitutional rights at the schoolhouse gate,” the lawsuit said. “No compelling state interest exists to justify the censorship of A.P.’s religious expression.”

  1. Way to go! It’s called 1st Amendment rights and unless the Consitution of the United States is abolished no one can take these rights away not even in a public school setting.

    Went through something not too many years ago and that led me to do alot of research. My son was denied the right to play Noah as a historical figure. The teacher he could not do it because it might offend something (she meant the muslims in the class). The principal told me he could not do it because there is no way to prove his DOB. Sheesh, little did she know until I gave her an ear full that his DOB can be proven using Jewish calculations and calendar. Well, he ended up playing the role of Roger Williams and basically ended up giving the information about him and giving his first “sermon.” God does work in mysterious ways. In his permanent school file there is a letter from me using the letter that can be found at the following webiste as a guide,

    Had the kid had posted a demon drawing, that would have got him an A. Perhaps, two man lovers would have got him an A plus. Of course, that would have been real fagot secular humanist religion type stuff.

    In my opinion, I think that this teacher is an idiot. Something makes me want to agree somewhat with Leatherneck. Who knows, maybe this teacher is a ‘queer’ that is into demons…LOL!! I bet the student would’ve got a A+ had he created some filth like that that the school systems seem to push. No wonder most American children are so out of control. They do not have the guidance that is needed by responsible adults. I think we are very limited on responsible teachers in America. They have liberal teachers who want to teach immoral practices instead of what the students need which is REAL guidance which comes from the Bible and God. The problems started when they brought in the condoms, quit paddling students and then giving them more rights than their parents and throwing the Bible out the window. We as parents aren’t allowed to discipline our children anymore. I’m not too sure but I think these ideas came from a man known as Dr. Spock. I heard that his son committed suicide. Do you think that his system failed him also? I’m wondering if the teachers will ever learn before it is too late for them also. So, to all the teachers in America, don’t be stupid enough to ask why the children have gone in the wrong direction when there is a shooting at YOUR school or your child’s school and your child is killed. It seems to me that that is what you get since that is the kind of immorality that you push for. So read it and weep for your country and the children who are involved with your immoral teachings.
    WAKE UP AMERICA AND SMELL THE COFFEE BEFORE IT IS TOO LATE.

    Actually, Dr. Spock was just one cog in the Communist gears… There’s a book I read (sorry, I still haven’t had my cup of coffee this morning and can’t remember the name of the book) that traces all of this crap back to the Communist movement that was trying to take over America….

    I’ll brew up some coffee and see if I can dig the book out of my library…

    It’s a shame that America is not standing on our original values that were brought over on the ships when our country was founded. I’m amazed at our school system and what they so call ‘teach’ our children. I was appalled when I watched Bill Clinton on television say ‘that he had not had sexual relations with that woman’ when we all know that he did just by what he did and then on top of that had the audacity to ask just what their definition of the word ‘is’ is. That totally blew me away, I thought I would fall out of my chair!!! I thought he had more brains than that but he showed the world exactly which brain was thinking at that point. From that stemmed an epidemic in the American school system of students that were doing the same thing and they also were thinking that they weren’t having sexual relations either. Wonder what’s the percentage of teenagers that have STD’s now, GO FIGURE!!!!

    That article on ‘The Techniques of Communism:INVADING EDUCATION’ is an eye opener. I didn’t realize that it started that long ago. I thought it was a 70’s thing. It’s a sad day when people cannot learn from history the mistakes that have been made so that we’re not condemned to repeat them again. As I shake my head in disbelief, I have to wonder just what happened to good old common sense. I guess it was tossed out right behind the Bible. What a shame.

Evidently, (from what I have read) he was “unknowingly” seduced by the communist’s secret agenda and became one of the leaders of the anti-Vietnam war movement…

    Your example would almost be funny if it wasn’t so true.
    I was not aware that Dr. Spock was against the Vietnam war. It stands to reason with his other beliefs, I guess. Jane Fonda is a piece of work with everything that she caused with our prisoners of war over her ignorance. I wonder if she’s matured enough now to realize the living hell that she caused them and just how stupid she looked to most of the world. If not, I hope she matures quickly before it’s too late and she croaks!! Has she ever apologized to those men and our country for her stupidity? If it was me and I had done something that stupid, I’m not too sure that I’d be able to handle the guilt from what happened to those prisoners from the horrible choices that she made on that dreadful day. I saw a documentary on that trip that she made over there. I don’t think she could’ve made herself look more like a moron than she did on that day. I probably would’ve committed suicide had I done something so stupid to our men and our country as again. I wouldn’t be able to handle the guilt of my actions. I wonder what Henry Fonda thought about that?

    As for the student who has the law suit against the school system, he should sue the pants off of his teacher, as well. Make him spend most of his retirement in having to get ‘crooked lawyers’ to defend him. Maybe it will help the other ‘liberal (so called) teachers’ to actually think about what they are teaching and saying to our students and to know that THEY will also be held accountable for THEIR actions which seems to stem out of THEIR ignorance. I wish him luck in our justice system. One never knows which way our courts will go, as they also never cease to amaze me with their logic and ways of thinking. Common sense isn’t a biggy in our judicial system nowadays either. I think it’s becoming extinct in our society. Maybe I should start a fund to save and protect what little ‘common sense’ we have left in the ‘good ole US of A’.
