Navy SEALs Face Assault Charges for Capturing Most-Wanted Terrorist

Navy SEALs have secretly captured one of the most wanted terrorists in Iraq — the alleged mastermind of the murder and mutilation of four Blackwater USA security guards in Fallujah in 2004. And three of the SEALs who captured him are now facing criminal charges, sources told FoxNews.com.

The three, all members of the Navy’s elite commando unit, have refused non-judicial punishment — called an admiral’s mast — and have requested a trial by court-martial.

Ahmed Hashim Abed, whom the military code-named “Objective Amber,” told investigators he was punched by his captors — and he had the bloody lip to prove it.

Now, instead of being lauded for bringing to justice a high-value target, three of the SEAL commandos, all enlisted, face assault charges and have retained lawyers.

Matthew McCabe, a Special Operations Petty Officer Second Class (SO-2), is facing three charges: dereliction of performance of duty for willfully failing to safeguard a detainee, making a false official statement, and assault.

Petty Officer Jonathan Keefe, SO-2, is facing charges of dereliction of performance of duty and making a false official statement.

Petty Officer Julio Huertas, SO-1, faces those same charges and an additional charge of impediment of an investigation.

The three SEALs will be arraigned separately on Dec. 7. Another three SEALs — two officers and an enlisted sailor — have been identified by investigators as witnesses but have not been charged.

FoxNews.com obtained the official handwritten statement from one of the three witnesses given on Sept. 3, hours after Abed was captured and still being held at the SEAL base at Camp Baharia. He was later taken to a cell in the U.S.-operated Green Zone in Baghdad.

The SEAL told investigators he had showered after the mission, gone to the kitchen and then decided to look in on the detainee.

“I gave the detainee a glance over and then left,” the SEAL wrote. “I did not notice anything wrong with the detainee and he appeared in good health.”

Lt. Col. Holly Silkman, spokeswoman for the special operations component of U.S. Central Command, confirmed Tuesday to FoxNews.com that three SEALs have been charged in connection with the capture of a detainee. She said their court martial is scheduled for January.

United States Central Command declined to discuss the detainee, but a legal source told FoxNews.com that the detainee was turned over to Iraqi authorities, to whom he made the abuse complaints. He was then returned to American custody. The SEAL leader reported the charge up the chain of command, and an investigation ensued.

The source said intelligence briefings provided to the SEALs stated that “Objective Amber” planned the 2004 Fallujah ambush, and “they had been tracking this guy for some time.”

The Fallujah atrocity came to symbolize the brutality of the enemy in Iraq and the degree to which a homegrown insurgency was extending its grip over Iraq.

The four Blackwater agents were transporting supplies for a catering company when they were ambushed and killed by gunfire and grenades. Insurgents burned the bodies and dragged them through the city. They hanged two of the bodies on a bridge over the Euphrates River for the world press to photograph.

Intelligence sources identified Abed as the ringleader, but he had evaded capture until September.

The military is sensitive to charges of detainee abuse highlighted in the Abu Ghraib prison scandal. The Navy charged four SEALs with abuse in 2004 in connection with detainee treatment.

    What a load of bull. Paste the pictures of the US security guards mutilated bodies in the courtroom and then let the SEALS be tried by a jury of their peers. (or a jury of hard working Americans) I have no doubt they would be treated as heroes.

      The touchy subject is one of a few things I think I might know from my past and looking at these informative articles and have the time to jot down here in my current situation and maybe as someone who intelligebly can respond.I heard of this group, anyhow, from North Carolina having grown up in Florida and being in touch with certain things and don’t want to hear that anyone is busted when wronged first.The charges they face are too a result of some diar consequences and I don’t much think warranted or understand but definitely vouch that things go that way in such areas of living etc.

      Why do I think that? Because if you are in the Military and you did something wrong, you’re going to take the Article 15 (Admiral’s Mast) over a Court Martial anyday. These 3 Seals turned down the Article 15 and asked for a Court Martial. They’re innocent.

    It is a sad day for america when hard working, life giving, US protecting military personnel have to stand courts martial for a guys bloody lip, especially a guy who is known to burn mutilate and display bodies like some prize. when the military begins to worry about a bloody lip it ceases to be an effective fighting force.
    Now it is starting to feel like Vietnam, no respect for those serving and the dangers that they face.

    One of the men in the attack in 2004 was a prior Navy Seal. The 3 other men were prior Army Spec Ops. They were murdered and then brutally hung from a bridge where children were cheering in front of the bodies. The justice lies only on the battlefield where they should have left Abed’s dead remains.

    What are we teaching our soldiers? That they cannot use any force required to fulfill their mission and to protect their lives. That the wellbeing of our enemies is more important that the wellbeing of our own troops?

    When this government will STOP treating enemies as citizens and citizens as enemies?

    Who will be willing to put their lives on the line for the reward of being accused by the same commander who send them to battle?

    This disgrace goes beyond the limits. We are in a WAR and we shall support our troops in ALL possible ways.

    It has nothing to do with rights or public perception. Men who are trusted to protect our representatives are charged with a responsibility that is almost indefinable. That is what special operations troops are trained for. What matters in today’s society is the culpability of (non-team trained recruits) shitheads and cowboys. I learned from some of the best trained MEN in the world… side by side with silver-star killers and exerienced men wearing the badges, not that badges mean a thing, but these men wore them with pride. Backwater didn’t help us. Don’t beat me up for pointing out what the ignorant public doesn’t know. As a former operaterator I know what it is to defend your own and protect the principal.. This problem will be used by friend and foe.. Operators will know that an interrogation, by friend or foe, is just that. Trust our training and believe in the team is all that we are. TEAM!

    this is bull. that picture is a picture of four blackwater usa security guards after being shot and burned in fallujah. seals had nothing to do with this. don’t believe this post, there just coming up with a ton of bs to attract people to their website. what you’re reading never happened. seals never went into fallujah either. it was us marines, british army, and iraq resistence fighters. our military would never do such a thing to their own soldiers. stuff like this rarely happens, especially in our modern wars. if it said this happened in vietnam, i would believe it, but our military has been re-disciplined since then.

      The photo is there to remind the readers what the little punk Ahmed Hashim Abed was guilty of doing. Namely, masterminding the killing and mutilation of Blackwater USA security guards.

      Then, when you read the article, you discover that the punk “mastermind” responsible for this horrific act has finally been captured, but is whining and complaining about his supposed “mistreatment” at the hands of his captors. And, what does this supposed mistreatment entail? An alleged punch which resulted in a bloody lip! Waah! Cry me a freakin’ river!

      If I would have been there, I would have put a bullet through his little “master” mind! But, I digress.

      Anyway, you just misunderstood my usage of the photo. No harm, no foul.

      P.S. – I don’t quite understand why you think the SEALS didn’t have anything to do with the capture of the little punk mastermind. Clearly, they had to have had something to do with it as they are the ones who were falsely accused of wrongdoing.
