Obama Held Dual Citizenship Until 1982

Yup, this must be true, even Obama admits it on his Official Website, Fight the Smears:

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.

Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”

Now, I’m not a Constitutional Lawyer, but I’m pretty sure this is definitely stretching the INTENT of Article 2, Section 1, Clause 5

Update: While looking into all of this, I noticed that NewsBusters is also covering this.  As I was reading the comments, I came across this interesting comment from Amber in response to a commenter claiming that this was a non-issue:

“Actually, no, you are wrong.  Up until Reagan, if you were a dual citizen, you lost your US citizenship.  The US did not allow dual citizenship.  Also, his case is very different since he is running for president.  The rules are more strict if one of your parents was not a US citizen.  According to the law on the books, I do not believe he can legally run for president.  His mother was not old enough at the time of his birth for him to qualify since his father was not a US citizen and he held dual citizenship even after he turned 18 (actually tri, since he was adopted by an Indonesian man and taken to live with him, I believe they considered him an Indonesian ctizen, but I am not sure about that one).”

Yup, that warrants further investigation once I get some free time…

    I have seen this Kenya issue on quite a few blogs, I am damned sure that someone is planting red herrings. First and foremost, I have not seen any evidence that his parents were actually married at the time. According to English law at the time he would then have been considered a bastard and not have any rights. Kenya- I was living there at the time_ was at the height of the Mau Mau rebellion and say what you like about the British, their intelligence services in their colonies was top notch. I knew many Englishmen who spoke better Swahili, Kikuyu or Luo than the locals did. They looked very closely at any black leaving the country for whatever reason, they paid even more attention to the educated ones, I would bet my last penny that the SIS had a file on Obama snr. If they did, Gordon Brown has inherited it, that may well be the reason for his unprecedented endorsement, otherwise a strict no-no for a sitting prime minister. Assuming his parents were married at the time, Obama would have had to go to the British embassy to register the birth and whilst British law in Kenya accepted multiple marriage for the indigenous and muzzies, it would never accept it when a white woman was involved. You may recall Obama’s father was already married by local custom.
    Incidentally, that local custom consisted of giving the father of the bride anything from 2 goats to a dozen cows, depending on the fathers status, so in this respect Obama senior got a bargain.

    If true he wouldn’t be eligible to run for President, and removed from the Democratic campaign, would Hillary Clinton be allowed, as second Democratic candidate, (and with more popular votes than Obama), to run for President then? That would sure make Clinton supporters happy. This campaign gets more twists and turns each day.

    Let me throw in another musing for you:

    Obama’s mother married an Indonesian.

    Now, if what I have found on the net can be believed, there are some interesting things going on here:

    In the Indonesian marriage laws, women and their children are considered the sole property of the husband, and in the eyes of the law, automatically forfeit their previous nationality, becoming an Indonesian citizen only. Basically, by marrying an Indonesian, you are renouncing your U.S. citizenship and, as Legal guardian, automatically renouncing your children’s original citizenship;

    The plot thickens!

    It may well be that Obama is trying to keep everyone focused on the Kenya issue in an effort to obfuscate the legal issues from Indonesia…

    The rabbit hole goes deep with this One!

    In the 60s, Indonesia was still fairly un-muzzie, sharia only started creeping in there after 73. Those were the days Sukarno was still sucking up to the states.He would have been registered as Indonesian to get into school . He most likely had an Indonesian passport to travel to Pakistan in the 80s, they did not like Americans in those days. Once back in the states, all he would have had to do is show a birth certificate and bingo, new passport. Kenya is defenitly a red herring. No way would the British have handed him citizenship.

    Yup, I think you’re on to something. Obama DID renounce his U.S. citizenship in Indonesia. Then, didn’t say anything about it when he returned state-side…

    He did not have to renounce citizenship, he was registered as the other guys son, it would never have been assumed he had any other citizenship. Also, he was a minor and could only claim citizenship once he reached age. I would imagine he returned to Hawaii with his mother on her passport. I doubt he would have had one of his own.

    Right. He did not have to physically renounce his citizenship; he was a minor. From what I can ascertain from reading the blogs (Free Republic) , according to Indonesian law, the marriage contract is a akin to making a statement of renunciation of one’s previous citizenship, and since she had a son (Barack) and was the legal custodian of him – a minor – she was, in effect, renouncing Barack’s citizenship on his behalf… So, he didn’t have a choice in the matter, really.

    And, yes. I think you are correct in that he probably didn’t have a passport because he was only about 10 years old when they returned from Indonesia after his mom & stepfather got divorced. Or, did they? Were they even really married?

    Does anyone reading this know for sure and can supply a link? Obviously, I mean; besides Obama’s biased and narcissistical autobiographies, I don’t think I’ve ever seen anyone actually look into that …

    Well, that’s about all I’ve read on this topic, and it comes from the blogger community at Free Republic – which is usually a good source of hidden knowledge. But, I haven’t seen any legal documents. So, it beats me if there is anything here or not. However, it would be nice if an investigator could fly out to Indonesia and check all of this stuff out.

    That would either put it to bed or wake up a sleeping giant…

    Sir Seretse Khama, paramount chief and first prime minister of Botswana (one of the very few good guys) married a white woman in London. When he returned home their were attempts to strip him of his chieftainship. If you think it was only the whites against mixed marriage, think again. A good woman that costs a dozen cows is worth something, when you can pick them up for nothing it is determined to be their worth. This was the African thinking at the time.
    As for sending an investigator there, not a snowballs chance in hell. Indonesia has made a hard right turn to Islam in the last few years, if they have anything on him, it will now be held at the highest levels, a suitable bargaining chip for future use. I you would follow the local press there, which is under the strictest state control, they all proclaim him as the new messiah.

    A US citizen cannot have his own citizenship renounced by anyone but himself and they must do it before a US official. Obama did not do that as a 6 year old and his citizenship in the US supercedes his mothers choices in marriage. Whatever the law is in Indonesia, Obama was born in the US and is a US citizen. As for the dual citizenship thing, he was born in the US, and I don’t see any laws that state if his father was born elsewhere that it makes him ineligible. In fact, the founding fathers had to realize that there would be parents with other origins-it was a country filled with immigrants-but based the law on where the person/citizen is born. Otherwise, there would be laws as to how many generations must be citizens before our own birth and citizenship actually counts.
